TÓM TẮT NHỮNG KẾT LUẬN MỚI CỦA LUẬN ÁN
1. Pháp luật bảo hiểm y tế là
tổng thể các quy phạm pháp luật điều chỉnh các quan hệ xã hội phát sinh trong
quá trình tham gia, thụ hưởng bảo hiểm y tế theo nguyên tắc tương trợ cộng
đồng, chia sẻ rủi ro dưới sự đảm bảo của Nhà nước vì mục đích an sinh xã hội.
2.
Các
quan điểm hoàn thiện pháp luật bảo hiểm y tế ở Việt Nam hiện nay: 1) Kết hợp hài hòa giữa
chính sách, pháp luật về y tế và chính sách, pháp luật về bảo hiểm y tế; 2) Nhanh
chóng mở rộng đối tượng tham gia bảo hiểm y tế, thực hiện thành công lộ trình bảo
hiểm y tế bắt buộc toàn dân trong thời gian sớm nhất; 3) Mở rộng phạm vi quyền
lợi, nâng cao mức hưởng và đảm bảo chất lượng khám chữa bệnh bảo hiểm y tế; 4)
Thực hiện xã hội hóa hoạt động bảo hiểm y tế, trong đó nhà nước giữ vai trò
trung tâm.
3.
Các giải pháp hoàn thiện pháp luật bảo hiểm y tế ở Việt Nam hiện nay: 1)
Đổi mới quan điểm, nhận thức và nâng cao vai trò lãnh đạo của Đảng về phát
triển bảo hiểm y tế, thực hiện bảo hiểm y tế toàn dân; 2) Hoàn thiện công tác
lập quy về bảo hiểm y tế gồm: Sửa đổi, bổ
sung quy định để thực hiện bảo hiểm y tế toàn dân; Sửa đổi, bổ sung các
quy định nhằm đảm bảo quyền và lợi ích của người thụ hưởng bảo hiểm y tế; Sửa
đổi, bổ sung quy định về thủ tục bảo hiểm y tế theo hướng đơn giản, thuận tiện
và tiết kiệm chi phí; Hoàn thiện các quy định nhằm quản lý, sử dụng và kiểm
soát quỹ bảo hiểm y tế; Bổ sung quy định về chế tài đảm bảo tính tuân thủ pháp
luật bảo hiểm y tế; 3) Rà soát, hệ thống hóa, pháp điển hóa hệ thống pháp luật
về bảo hiểm y tế.

SUMMARY OF NEW CONCLUSIONS OF THE THESIS
1. The Law on Health insurance is the overall legal
regulation that controls over social
relations arising in the process
of participation, health
insurance benefit under the principle of supporting the community and
risk-sharing under the State protection for social security purposes.
2. Points to complete health
insurance law in Vietnam at
present: 1) Mixing and matching
between health policies, legislation
and policies, legislation on health insurance ; 2) Rapidly
expanding subjects participating in health insurance, implementing successfully
the routine of compulsory health insurance
among the people in the earliest;
3) expanding the scope of benefits and
raising benefit levels and ensure
quality of care and treatment using
health insurance, 4) Undertaking socialization of health insurance, in which the State plays a central role.
3. The solutions to improving the health insurance law in Vietnam
at present: 1) Innovating
perspective, awareness and increasing
the Party's leadership role in developing health insurance,
implementing universal health insurance
among the people, 2) completing the
elaboration of health
insurance include: amend and supplement the provisions to implement
universal health insurance; amend and supplement the
regulations to ensure the rights
and interests of health insurance
beneficiaries; amend and
supplement regulations on health
insurance procedures towards
simplicity, convenience and cost
savings; finalize regulations for better management, usage and control of health insurance funds; Add more regulations on financial institutions to ensure compliance with health insurance law, 3) reviewing, systematizing and codificating the legal
system on health insurance.
