TÓM TẮT NHỮNG KẾT LUẬN MỚI CỦA LUẬN ÁN

1. Thực hiện pháp luật về trợ giúp pháp lý là quá trình hoạt động có mục đích, có chủ định của các cơ quan Nhà nước, tổ chức xã hội và các chủ thể khác, nhằm làm cho các quy phạm pháp luật về trợ giúp pháp lý đi vào cuộc sống, trở thành những hoạt động thực tế của các tổ chức, cá nhân tham gia vào quá trình thực hiện pháp luật về trợ giúp pháp lý, mục đích bảo vệ các quyền và lợi ích hợp pháp cho những người có hoàn cảnh kinh tế khó khăn, người có công với cách mạng, trẻ em không nơi nương tựa, người già cô đơn, đồng bào dân tộc thiểu số.

           2. Các giải pháp bảo đảm thực hiện pháp luật về trợ giúp pháp lý trong điều kiện xây dựng nhà nước pháp quyền ở Việt Nam: 1. Tăng cường sự lãnh đạo của Đảng trong lộ trình thực hiện pháp luật về trợ giúp pháp lý từ nay đến năm 2020, định hướng năm 2030; 2. Tiếp tục hoàn thiện pháp luật và chính sách trợ giúp pháp lý ở Việt Nam; 3. Kiện toàn tổ chức bộ máy và nâng cao năng lực và phẩm chất đội ngũ cán bộ, công chức, viên chức và những người tham gia thực hiện pháp luật về trợ giúp pháp lý; 4. Đẩy mạnh công tác tuyên truyền, phổ biến pháp luật và đổi mới hoạt động truyền thông về trợ giúp pháp lý đến mọi người dân; 5. Tăng cường quản lý của Nhà nước thực hiện pháp luật về trợ giúp pháp lý trong điều kiện xây dựng nhà nước pháp quyền ở Việt Nam; 6. Tăng cường kinh phí, bảo đảm điều kiện vật chất cho việc thực hiện pháp luật về trợ giúp pháp lý; 7. Nâng cao vai trò nòng cốt của Trung tâm trợ giúp pháp lý Nhà nước trong việc thực hiện pháp luật về trợ giúp pháp lý; 8. Tăng cường thực hiện trợ giúp pháp lý trong hoạt động tố  tụng ; 9. Đẩy mạnh hoạt động kiểm tra, thanh tra, giám sát và xử lý các vi phạm trong việc thực hiện pháp luật về trợ giúp pháp lý; 10. Khuyến khích các tổ chức, và cá nhân tích cực tham gia và mở rộng hợp tác quốc tế trong quá trình thực hiện pháp luật về trợ giúp pháp lý.

SUMMARY OF THE STUDY CONCLUSIONS

         1.Implement the law on legal aid is the process of purposeful activities with the intention of the State organs, social organizations and other entities. This is to make the normative law on legal aid delving into the life, becoming the actual acts of organizations and individuals involved in the process of carrying out the law on legal aid. This purpose is to protect the lawful rights and interests for people who have difficult economic circumstances; the person who have contributed to the revolution; for homeless children; lonely elderly and ethnic minorities.

2. Solutions to ensure the implementation of legislation on legal aid in terms of building the rule of laws in Vietnam: 1. Strengthening the Party's leadership in the process of carrying out the law on legal aid between now and 2020 and orientating towards 2030; 2. Keeping on improving the law and legal aid policy in Vietnam Nam; 3. Strengthening the organizational structure, capacity and quality of staff, civil servants, officials and the people who participate in implementing the laws on the legal aid; 4. Carrying out the operation, and disseminate the laws and innovate communication activities of legal aid to most people; 5. Strengthening the management of the State implementation of the law on legal aid in the condition of building the rule of laws in Vietnam; 6. Increasing funds to ensure the material conditions for the implementation of the laws on the legal aid; 7. Raising the main role of the State legal aid Center in the performing laws of the legislation; 8. Strengthening of the implementation of legal aid in proceedings; 9. Promoting activities of testing, inspection, supervision and handling of violations in the implementation of the laws on legal aid; 10. Encouraging organizations and individuals to actively participate and expanding international cooperation in the performing of the laws on the legal aid.
